While it is not a new requirement, the Oklahoma Department of
Environmental Quality (ODEQ) has been reminding large quantity
generators (LQG) of hazardous waste of the Contingency Plan
requirement. Title 40 of the Code of Federal Regulations (CFR) §262
Subpart M details the Contingency Plan requirements. A Contingency
Plan must describe the actions facility personnel will take in response to
fires, explosions or other unplanned releases of hazardous waste. The
Plan must also list the contact information for the emergency coordinator, emergency response equipment onsite and include an evacuation plan. Additionally, LQGs that amend their Contingency Plan after May 30, 2017
are required to prepare a quick reference guide of the Contingency Plan
for submittal to the local emergency responders (i.e., police departments,
fire departments, hospitals and State and local emergency response
teams that may be called upon to provide emergency services) or the
Local Emergency Planning Committee (LEPC).
In Oklahoma, Tier II reports submitted to the ODEQ are also automatically
routed to the local fire departments and LEPCs by the ODEQ. So, a LQG
can satisfy the Contingency Plan submittal requirement by uploading their Contingency Plan with their Tier II report, due by March 1.
